The National Labor Relations Board (NLRB) a quasi-judicial body tasked with investigating, prosecuting, and remedying unfair labor practices, is unsurprisingly suffering due to the agenda of the Trump Administration’s effort to limit its powers. Long a thorn in the side of anti-union Republicans and others opposed to sustaining the rights of workers, and rulings by the Board that are often in support of their cases, the take-down of the Board seems imminent. Recently, the Trump v. Wilcox case was brought before the conservative-stacked court Justices. Trump had attempted to remove NLRB Chair Gwynne Wilcox before her term ended. It was challenged as unlawful, and the Court issued a stay allowing the removal to stand temporarily. However, the damage was done, at least in that the NLRB docket has quieted down in the last six months. Employers are expected to experience a continued reprieve for the foreseeable future.
