The Progressive Magazine has revealed a threat from Menard's stores to cut managers' pay by 60% should a union be organized there. The threat is in a contract provision obtained by The Progressive.
It says “The Manager’s income shall be automatically reduced by sixty percent (60%) of what it would have been if a union of any type is recognized within your particular operation during the term of this Agreement." Carin Clauss, emeritus professor of law at the UW-Madison and former U.S. Solicitor of Labor, says Menard's could face a valid legal challenge if a complaint is filed with the National Labor Relations Board.
