Make Sure Your Real Estate is in Good “Form” PDF Print E-mail

Lately, we have come across several situations involving improper formation of real estate holding companies that hold real property occupied by a union local and/or its related benefit funds.

Real estate holding companies (REHC) are specifically formed to hold title for and control real property. Union locals generally own 100 percent of an REHC as a wholly-owned subsidiary. However, if a C corporation is formed to hold the real property, there are certain application forms that must be filed with the Internal Revenue Service to qualify the entity as a not-for-profit REHC.

By Marc Bussanich, LaborPress City Reporter

Chris Shelton, Vice President for CWA District 1, said at a CWA Local 1101 rally outside a Verizon garage on King Street on Friday, February 3, that there has been no progress in the talks on major cost-sharing proposals between the union and the company. “The company still has a lot of retrogressive demands on the table that we’re not ready to agree with, and will never be able to agree with,” said Shelton.

Rebuilding the World Trade Center brings jobs to ironworkers, but not forever

One World Trade Center is now easily visible from much of Manhattan and Brooklyn, towering more than 90 stories over the City.

Full employment has returned to unions like the Metallic Lathers and Reinforcing Ironworkers Local 46, thanks almost entirely to the work of rebuilding. More than a third of Local 46’s members now work at Ground Zero. But the project is now at its peak, and will be finished in a few years. To create new construction jobs for union workers, Local 46 has joined with the rest of the building trades to negotiate project labor agreements that offer concession to developers in return for commitments to build union.

January 6, 2012
Around Town – By Neal Tepel

Newly-adopted green building codes are expected to put the city on track to meet PlaNYC’s goal to lower carbon emissions, energy consumption and waste. Buildings account for 75 percent of the City’s total greenhouse gas emissions and 95 percent of total electrical consumption. The adoption of recommended procedures will divert 100,000 tons of asphalt from landfills each year; reduce greenhouse gas emissions citywide by 5 percent; lower the costs of lighting energy by 10 percent; and provide $400 million in savings by 2030.

Thou Shall Not Pay Area Standards PDF Print E-mail
DC 9 MembersFebruary 3, 2012
By Marc Bussanich, LaborPress City Reporter

George Carlin used to rant against the Catholic Church for not paying taxes. Apparently, the Archdiocese of New York is balking at paying area standards to workers in the construction trades, according to Jack Kittle, political director for DC 9.

On February 1, DC 9 members stood outside the Archdiocese’s offices handing out flyers that were short on specific grievances, but long on Catholic canon.

By Marc Bussanich,
LaborPress City Reporter

In November 2010, Renaissance Equity Holdings locked out 70 members of SEIU 32BJ at the Flatbush Gardens complex because the workers refused to accept a new contract calling for a 30 percent wage cut. The union filed a lawsuit claiming the lockout was illegal. Last week the workers got some good news when the National Labor Relations Board filed a motion for an injunction to reinstate the workers. But now a federal judge must decide whether an injunction is or is not appropriate.

The Politics of Teacher Evaluations PDF Print E-mail
Rchard C. Iannuzzi, President, New York State United TeachersFebruary 1, 2012
By Marc Bussanich, LaborPress City Reporter

Some politicians are claiming that unless the state finalizes its teacher evaluation system, it is at risk of losing $700 million in Federal Race to the Top money. The state’s teachers union worked hard to create a comprehensive and fair evaluation system. But Governor Andrew Cuomo demanded more reliance on standardized testing. The full implementation now hinges on when an appeals court makes a decision in favor of the union’s version or Cuomo’s.

The Growing Arteriosclerosis of America's Political Institutions PDF Print E-mail

Thomas J. Mackell Jr.

When Newt Gingrich arrived in Congress in 1978 he said that.... "We the Republicans are not going to be able to take over unless we demonize the Democrats."

And demonize them he did. His remarks helped to embellish on and heighten the dramatic schism that has grown to out-and-out, hand-to-hand political combat in Washington today where each party is seemingly locked into their political orthodoxy.

The Flatter Tax PDF Print E-mail
January 30, 2012
By Ed Koch Commentary

I don’t believe class conflict is harmful to our country, as long as it is limited to elections.  It is also helpful if the charges made by both sides in this conflict are factually correct.

The Republicans are the party of the wealthy.  Its membership, however, is made up primarily of people who do not fit that description and are not in the 1 percent of our population with an income of $380,000 and above. Those people, not part of the 1 percent, have an expectation of someday becoming part of that small group which pays just over a fourth of all federal taxes, according to the Tax Policy Center.  It also may be that even if they don’t expect to be part of it, they hope their children will be, and they want to protect the prerogatives that come with wealth.  The major political tenet of these people is – success comes to those who strive to make it and do on their own. I truly believe that is the meaning of Newt Gingrich’s statement that President Obama is “the most effective food stamp president in history,” and “I would like to be the best paycheck president in American history.” Mitt Romney decries these criticisms of Republican philosophy as “the bitter politics of envy.”

Supporting Reproductive Health Care Rights PDF Print E-mail

January 30, 2012
Around Town  By Neal Tepel

The Assembly has passed a resolution calling on Governor Cuomo to proclaim Reproductive Rights and Justice Week, January 22-28. The resolution, K.828, sponsored by Assembly Member Deborah Glick, had been favorably reported from the Assembly Health Committee, chaired by Assembly Member Richard N. Gottfried, earlier today. The committee also reported three bills.

"Access to reproductive health care services, essentially primary care for women, is supported by the vast majority of New Yorkers," said Assembly Health Committee Chair Richard N. Gottfried. "Making sure that these services remain available is a top priority every year in the Assembly."
The resolution encourages public awareness, conversation, and support for reproductive rights and justice nationwide.
